Registration of marriage in Portugal
Marriage registration in Portugal is carried out by the state civil registry body. According to local legislation, a person who:
- has reached the age of 18 (in some cases 16);
- is not in another marriage;
- is not a relative of the first, second or third line of kinship of the other spouse;
- doesn’t have a previous parental relationship with the other spouse;
- has not been convicted (not prosecuted) for the murder of the other spouse in a previous marriage.

The documents, necessary to address for conclusion of marriage:
- an identity document (for foreigners, this is a foreign passport, temporary or permanent residence permit);
- a certificate of the conclusion of a marriage contract (if the marriage contract was not concluded in the civil registry authorities).
- power of attorney (in case of submission of documents by a representative), in which the other spouse and the type of marriage (formal or a non-marital partnership) must be indicated.

Termination of marriage in Portugal takes place in two ways:
- by agreement of the parties: on the basis of the application of both spouses to the state civil registry body;
- by the initiative of one of the spouses: by the initiator's court action.
Termination of marriage with the consent of the parties is carried out on the basis of the following documents, submitted to the state civil registry body:
- statement;
- a list of joint property and its value (if the property is not divided), or an agreement on the division of property;
- marriage contract certificate;
- an agreement on the fulfillment of parental responsibilities (in case of minor children);
- other agreements: for example, regarding pets (if any), etc.
In the case of minor children, the documents are additionally checked by the prosecutor's office, which may suggest changes to the documents in order to protect the interests of the children. If the parents don’t agree with the proposed changes, the case is referred to the court.
After compliance with the above-mentioned points, the marriage can be terminated.
If one of the spouses doesn’t agree with the dissolution of the marriage or how the issues related to the children, the house or the property of the couple will be resolved, the only way to dissolve the marriage is to go to court.
