All persons who consider themselves heirs must apply for acceptance of inheritance either to a notary public or to local administrative service centers. The documents confirming family relations with the testator are attached to the application.
The person responsible for the organization of the inheritance, within three months, counting from the first day of the following month in which the person died, is obliged to apply to the local fiscal authorities with a statement (form) about the list of property, which is part of the inheritance.
Inheritance taxation in Portugal
Inheritance in Portugal is subject to stamp duty. Its size is 10% of the value of the property. The heirs of the first and second line are exempted from stamp duty.
